KDVA is currently in the process of lobbying for passage of a bill which would expand the state Domestic Violence statutes and allow persons in a dating relationship to be eligible for protective orders. Currently, dating couples who have not lived together or do not have a child in common do not fit within the definition of “members of an unmarried couple”, and therefore do not qualify to file a petition for a protective order. The proposed bill seeks to amend the definition to include those in a dating relationship (following the definition used in the federal Violence Against Women Act). We hope that this important piece of legislation will be enacted in the upcoming 2008 session, and bring Kentucky in line with the 40 other states which have enacted similar protection for this vulnerable population.
